Why this matters now
The Fifth vs Sixth Schedule distinction, autonomous district councils and PESA are tested in prelims/GS-2 — key to tribal rights and federal-special provisions.
The Fifth Schedule
The Fifth Schedule governs the administration of Scheduled Areas and Scheduled Tribes in states other than the four north-eastern states covered by the Sixth Schedule. The Governor has special powers (reports to the President), and each such state has a Tribes Advisory Council. PESA (1996) extends panchayat self-governance to these areas.
The Sixth Schedule
The Sixth Schedule provides for the administration of tribal areas in Assam, Meghalaya, Tripura and Mizoram through Autonomous District Councils (ADCs) and Regional Councils — which have legislative, judicial and executive powers over land, forests, customs and local matters, giving substantial autonomy.
Significance
These provisions protect tribal land, identity, customs and self-rule against exploitation and assimilation. Challenges include implementation gaps, land alienation, the demand to include more areas under the Sixth Schedule, and balancing autonomy with development.
UPSC angle
Distinguish 5th Schedule (Scheduled Areas/STs, most states, Governor + Tribes Advisory Council, PESA) vs 6th Schedule (Assam/Meghalaya/Tripura/Mizoram tribal areas, Autonomous District Councils with powers).
