Justice Jagmohanlal Sinha of Allahabad High Court on 12 June 1975 held PM Indira Gandhi guilty of 2 charges:
- Using Govt machinery (Yashpal Kapoor OSD, Indian Air Force officials) for election campaign.
- Building campaign infrastructure (PWD road, electric supply for campaign rallies).
The verdict declared Indira’s 1971 Rae Bareli election void and disqualified her from contesting elections for 6 years. Sinha allowed a 20-day stay to permit appeal.
24 June 1975: Justice V.R. Krishna Iyer of Supreme Court granted conditional stay — Indira could remain PM but couldn’t vote in Parliament.
Emergency proclaimed 25 June 1975
On the night of 25 June 1975, on Indira Gandhi’s advice, President Fakhruddin Ali Ahmed signed the proclamation of Emergency under Article 352(1) on grounds of internal disturbance — without Cabinet consultation. Trigger: JP Narayan’s 25 June Ramlila Maidan rally calling on police + army to disobey illegal orders.
