CAATSA waiver issue
The US Countering America’s Adversaries Through Sanctions Act (CAATSA) 2017 mandates sanctions on countries making “significant transactions” with Russian defence. India risked Section 231 sanctions for the S-400 deal. Turkey (also bought S-400) was sanctioned 2020 and removed from F-35 programme. India’s position: strategic autonomy + Russia-defence-dependence (60% legacy systems).
De facto waiver: Biden administration did not sanction India. NDAA 2022 + 2023 contained provisions for India-specific CAATSA waiver. Modi-Biden statement June 2023 confirmed no impediment.
