CAATSA waiver issue

The US Countering America’s Adversaries Through Sanctions Act (CAATSA) 2017 mandates sanctions on countries making “significant transactions” with Russian defence. India risked Section 231 sanctions for the S-400 deal. Turkey (also bought S-400) was sanctioned 2020 and removed from F-35 programme. India’s position: strategic autonomy + Russia-defence-dependence (60% legacy systems).

De facto waiver: Biden administration did not sanction India. NDAA 2022 + 2023 contained provisions for India-specific CAATSA waiver. Modi-Biden statement June 2023 confirmed no impediment.

Indigenous + Akashteer

Indigenous parallel: Akashteer (DRDO-BEL automated command-and-control system, deployed 2024) integrates Akash + S-400 + Barak-8 + future Project Kusha. Project Kusha (DRDO) — indigenous long-range SAM under development (350 km/300 km/150 km variants); approved Sept 2023 at Rs 21,700 cr; targeted induction 2028-30 to reduce S-400 dependence. Operationally: S-400 was used by India to repel Pakistan’s May 2025 drone-missile barrage during Operation Sindoor (after Pahalgam attack), shooting down 50+ incoming threats.
